Section 1 — Scope and Provider

Provider

The Terra Mia Immobiliare platform is operated by Oskar Golde as a sole proprietorship. The full provider details, including address and contact options, are set out in the legal notice.

Subject Matter

These terms of use govern the opening and use of a user account on the Terra Mia Immobiliare portals. They do not govern the mediation of holiday accommodation, nor the publication of property listings.

Relationship to the Other Terms

The mediation terms apply to the mediation of holiday accommodation, the listing terms to the publication of property listings. Those terms only come into being once you create a corresponding listing, and are presented to you separately for acceptance at that point. Opening a user account alone establishes no such agreement and commits you to no commission and no fee.

Fees

Opening and holding the user account is free of charge. Paid services are expressly identified as such before they are booked and are subject to their respective terms.

Section 2 — User Account

Registration

Registration requires a valid email address and a password of your choosing. The details given at registration and in the profile must be accurate and complete.

Confirmation of the Email Address

The account is activated only once the email address has been confirmed via the link sent to it. The confirmation link is valid for 24 hours; a new one can be requested afterwards.

Access Credentials

Keep your access credentials safe and do not pass them on to third parties. If you suspect that a third party has learned your credentials, please change your password immediately and inform Terra Mia Immobiliare.

Authorised Use

A user account may be used only by the person or company for whom it was opened. If you act for a company, you warrant that you are authorised to represent it.

Keeping Details Current

Please keep your contact details up to date. Declarations sent to the email address last stored are deemed to have been received.

Section 3 — Obligations of Use

Lawful Use

The platform may be used only within the applicable law and these terms. In particular, posting unlawful content, infringing third-party rights and any use liable to impair the operation of the platform are prohibited.

No Automated Use

The use of software to automatically read out, copy or bulk-retrieve content is not permitted without prior written consent. Terra Mia Immobiliare employs technical checks to guard against misuse.

Your Own Content

You are responsible for the content you upload or enter. You warrant that you hold the necessary rights, in particular to photographs.

Section 4 — Availability and Further Development

Availability

Terra Mia Immobiliare endeavours to keep the service running as smoothly as possible but does not owe uninterrupted availability. Maintenance work, technical faults or circumstances beyond its control may lead to temporary restrictions.

Changes to the Platform

Terra Mia Immobiliare may develop, change or discontinue platform features, provided this is reasonable for you and the purpose of the user account is not lost.

Section 5 — Term, Termination and Suspension

Termination by You

You may terminate your user account at any time and without giving reasons, in text form, or delete it using the function provided.

Termination by Terra Mia Immobiliare

Terra Mia Immobiliare may terminate the user account in text form giving 14 days' notice. The right to extraordinary termination for good cause remains unaffected.

Suspension

In the event of a material breach of Section 3, the account may be temporarily suspended. You will be informed of the suspension and the reason for it, unless legal grounds prevent this.

Consequences of Termination

On termination the right to use the account ends. Agreements already concluded under the mediation or listing terms, and statutory retention obligations, remain unaffected. Published listings are wound up under their respective terms.

Section 6 — Liability

Standard of Liability

Terra Mia Immobiliare is liable without limitation in cases of intent and gross negligence, and for injury to life, body or health. In cases of ordinary negligence, liability arises only for breach of material contractual obligations and is limited to the foreseeable damage typical of such contracts. Material obligations are those whose fulfilment makes proper use of the account possible in the first place.

Third-Party Content

No liability is accepted for content posted by users or for linked external offerings. If Terra Mia Immobiliare is notified of a specific legal infringement, the content concerned is reviewed without delay.

Loss of Data

For loss of data, Terra Mia Immobiliare is liable only to the extent that the damage would also have occurred had you carried out proper and regular backups.

Section 7 — Data Protection and Messages

Data Protection

How personal data is processed is described in the privacy policy.

System Messages

Emails necessary to operate the account — such as confirmation of the email address, sign-in notices or password notices — are sent to you regardless of any newsletter consent.

Newsletter

You receive promotional messages only if you have given separate consent to them. That consent is voluntary, is not required in order to use the account, and can be withdrawn at any time with effect for the future, for instance via the unsubscribe link in every promotional email.

Section 8 — Final Provisions

Changes to These Terms of Use

Terra Mia Immobiliare may amend these terms of use, for instance when the range of services is extended or the legal situation changes. An amended version is presented to you at your next sign-in; it takes effect only with your express consent. Until then, the version you last accepted applies. If you do not consent, you may end the account at any time under Section 5.1; further use of the account is not possible without consent. Agreements already concluded under the mediation or listing terms remain unaffected.

Applicable Law

German law applies. Vis-à-vis consumers, this choice of law applies only in so far as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence.

Dispute Resolution

Terra Mia Immobiliare is not obliged to participate in dispute resolution proceedings before a consumer arbitration board but is in principle willing to do so. The European Commission's online dispute resolution platform was discontinued on 20 July 2025.

Severability

Should any provision be invalid, the validity of the remaining provisions remains unaffected.
