CIN duty and fines for vacation rentals in Italy and what a breach costs in Sicily

Renting out without a CIN risks 800 to 8,000 EUR. If the CIN is missing from an ad, the fine is 500 to 5,000 EUR per unit and the ad is removed. Missing gas/CO detectors or fire extinguishers cost 600 to 6,000 EUR per violation. In Sicily, a missing sign carries its own range.

What happens when the CIN is missing

Anyone who rents out a property without a CIN risks a fine of 800 to 8,000 EUR, set according to the size of the property (Art. 13-ter para. 9, first sentence, D.L. 145/2023) 1. The same law covers three further breaches, all in para. 9. In Sicily, regional law replaces the national range for only one case, the missing sign on the building. Inspections and fines are handled by the municipality. How to obtain the CIN is covered in How to apply for the CIN for your vacation home in Sicily: step by step, with and without SPID; what it is and who needs it, in The CIN for vacation rentals in Italy: who needs it, where it must appear and what Sicily adds.

The fines at a glance

BreachDutyFine under para. 9
Renting out without a CINparas. 1 to 31st sentence: 800 to 8,000 EUR, depending on the size of the property
CIN not shown outside the building or not stated in an adpara. 62nd sentence: 500 to 5,000 EUR per unit, depending on size, and immediate removal of the faulty ad
Gas/CO detectors or portable fire extinguishers missingpara. 7, 2nd sentence3rd sentence: 600 to 6,000 EUR per violation found
Renting out in a business form without an SCIApara. 84th sentence: 2,000 to 10,000 EUR, depending on size

For renting out in a business form, para. 7, first sentence, also requires the prescribed safety of the installations. The sanctions of the applicable national or regional law apply to that 1.

Sicily: what the regional rule replaces and what it does not

Under Art. 13-ter para. 10, the fines of para. 9 do not apply if regional law penalizes the same conduct 1. Art. 38 para. 5 L.R. 6/2025 penalizes exactly one thing in Sicily: the CIN missing from the sign or from the outside of the building. That costs 500 to 2,500 EUR, doubled for a repeat within two years (para. 9) 2. The provision mentions neither ads nor websites nor intermediaries and portals 2.

For Sicily, this means:

  • If the CIN is missing from the building, the regional range of 500 to 2,500 EUR applies.
  • If it is missing from an ad, the national range of 500 to 5,000 EUR per unit stays, and the ad is removed.
  • Renting out with no CIN at all falls under the national range of 800 to 8,000 EUR. Regional law has no offense of “no CIN”.
  • For intermediaries and portals, only the national rule applies. Art. 38 para. 5 addresses owners, operators and legal representatives of the property 2.

The regional CIR has its own fine as well. Under Art. 7 D.A. 1783/2022 it has to appear in all ads. A breach costs 500 to 5,000 EUR under Art. 9, doubled for a repeat 3. This fine comes on top of the one for the CIN, because it concerns a different code. How municipalities read “the same conduct” in individual cases has not been settled. If in doubt, plan for the higher range.

Who enforces

Under Art. 13-ter para. 11, inspections and fines are the municipality's task. It acts through the local police under the procedure of L. 689/1981. The results are also passed to the Agenzia delle Entrate 1. The competent body is therefore the municipality where your vacation house stands, not the Ministry.

Gas and CO detectors, fire extinguishers: a duty with no exception in the law

Art. 13-ter para. 7, second sentence, applies “in ogni caso, tutte le unità”: every unit must have working gas and carbon monoxide detectors and portable fire extinguishers. The devices must be visible and within reach, especially near the kitchen and heat sources. One extinguisher is required per 200 m² or part of it, and at least one per floor 1. If something is missing, the fine is 600 to 6,000 EUR per violation found 1.

The law makes no exception. Art. 13-ter does not require smoke detectors. They are still a good idea, but the law does not require them.

The exception in the Ministry's FAQ and its limits

The law has no exception for the detectors. The Ministry provides one in its FAQ. According to FAQ 4.3, as Ufficio Commercio reproduces it in the version of January 16, 2026, landlords are exempt from the duty to install gas and CO detectors if the unit has no gas installation and an uncontrolled release of combustible gas or the formation of carbon monoxide is excluded with certainty 5. Both conditions must be met together.

In practice that leaves only an all-electric house: electric or induction cooktop, heat pump or air conditioning, no fireplace, no wood or pellet stove, no oil heating. Carbon monoxide forms in any combustion. A gas cylinder at the stove counts as a gas installation.

The limits of this exception:

  • It appears in an FAQ, not in the law. Under the case law of the Consiglio di Stato, FAQs are not a source of law and not binding, but they guide the conduct of those concerned 6.
  • The municipality that imposes the fine is not bound by the FAQ, and neither are courts.
  • Whether a landlord can successfully rely on the FAQ in fine proceedings has not been decided. An argument of legitimate reliance is possible, but it is not safe protection.

The safe route is therefore the equipment, because a missing device can cost 600 to 6,000 EUR.

The deadline of December 30, 2026

In Sicily the CIN can also be lost again. Under Art. 4 D.A. 1920/2026, anyone who filed the Allegato B notice by June 30, 2026 and still owes technical documents must submit them “entro e non oltre il 30 dicembre 2026”. Otherwise the property can be closed and its CIR and CIN revoked 4. Missing the deadline puts both codes, and with them the right to rent out, at risk. Find out early which documents are still missing.

What to do now

  • Check that your ad and your building show the CIN and the CIR.
  • Check that gas and CO detectors and fire extinguishers are in place in every unit.
  • Check whether you owe technical documents under D.A. 1920/2026.

At Terra Mia Immobiliare you enter CIN and CIR in the Basics step of the owner area. On the listing page they appear below the description. Listing is free, and a commission of 16% plus VAT is charged only when a booking is made. How to write a vacation rental listing in Sicily: photos, description, prices, CIN and CIR shows how to build the listing.

Frequently asked questions

What happens if I rent out my vacation home without a CIN?

Under Art. 13-ter para. 9 D.L. 145/2023, the fine is 800 to 8,000 EUR, depending on the size of the property. The municipality handles inspections and fines through the local police. In Sicily, CIR and CIN can also be revoked if owed technical documents are not submitted by December 30, 2026.

What does it cost if the CIN is missing from my ad?

500 to 5,000 EUR per unit, and the faulty ad is removed at once (Art. 13-ter para. 9, second sentence). That applies in Sicily too, because regional law penalizes only the missing sign on the building, at 500 to 2,500 EUR. For intermediaries and portals only the national rule applies.

Do I need gas and CO detectors if my house has no gas connection?

The law has no exception. In its FAQ 4.3 the Ministry names one, but only with no gas installation and a release of gas or CO excluded with certainty. The FAQ is not a legal norm and does not bind the municipality or the courts. The safe route is the equipment.

Do I need smoke detectors in my vacation home in Sicily?

Not by law. Art. 13-ter does not mention them. Gas and CO detectors and portable fire extinguishers are required. Smoke detectors are still a good idea as extra equipment.

How many fire extinguishers does a vacation apartment need?

One per 200 m² or part of it, and at least one per floor. The devices must be visible and within reach, especially near the kitchen and heat sources. If an extinguisher is missing, the fine is 600 to 6,000 EUR per violation found.

Who imposes the fine?

The municipality where the vacation house stands. It inspects through the local police under the procedure of L. 689/1981 (Art. 13-ter para. 11). The results are also passed to the Agenzia delle Entrate. The Ministry of Tourism does not impose fines.
